COMMERCIAL GUARANTEE FOR ENERGY LINE PRODUCTS

  1. Limited WarrantyTempel, S.A., (hereinafter also referred to as "Tempel"), a distributor of batteries and batteries of different types of electrochemicals (Lead Acid, Ni-Mh, Ni-Cd, Lithium, etc.), with registered office at Calle Cobalto, 4, 08907 in Hospitalet de Llobregat. Declares that the products marketed are free of any manufacturing or operational defects or damage caused by improper handling.

    Tempel, S.A., hereby grants the commercial guarantee (hereinafter also referred to as the "Guarantee"), provided that the products are used under the normal conditions of use determined by the manufacturers; and under the general terms and conditions expressed below:

  2. Warranty period
    1. The LPF (Lithium-ferro-phosphate) technology batteries in nominal voltages of 12.8V and 25.6V model NPFC marketed by Tempel, S.A., have a limited warranty of 12 months starting from the date indicated on the purchase invoice or delivery note of material.
    2. The LPF (Lithium-ferro-phosphate) technology batteries in nominal voltages of 48V model NPFC marketed by Tempel, S.A., have a limited warranty of 60 months starting from the date indicated on the purchase invoice or delivery note of material.
    3. Lead VRLA technology batteries marketed by Tempel, S.A., have a limited warranty of 12 months starting from the date indicated on the purchase invoice or material delivery note.
    4. Repairs carried out in Tempel, S.A. have a limited warranty of 90 days, which extends beyond the termination of the general warranty periods previously stipulated. This warranty will only cover the parts subject to repair or replacement, in no case the entire equipment.
    5. Warranty claims may be claimed during the established period of validity and immediately upon detection, except in the case of visible defects, in which case the claim must be made within a period of one month from the date of delivery and always before installation. For defects detected during transport, product breakage, etc., this must be reported within a maximum period of 24 hours after receipt and always indicated on the delivery note; after this period, no claim for this item will be accepted.
    6. It is possible to extend the warranty periods of the products, in accordance with the provisions of the extended warranty section.
  3. General terms and conditions
    1. The present commercial guarantee offered by Tempel, S.A., is aimed at its customers whose address is in any member or non-member country of the European Union.
    2. This commercial guarantee, as well as the extensions requested of the same, are only applicable to products supplied and invoiced by Tempel, S.A.
    3. In order for equipment to be considered under warranty, the warranty period must be justified by means of the delivery note or the original invoice issued by Tempel, S.A.
    4. The guarantee offered by Tempel, S.A. includes the cost of materials and labour necessary for the repair at our facilities.
    5. The warranty offered by Tempel, S.A., does not include the transport costs of sending the material to our facilities, these must be paid by the customer. If the product is within the warranty period, Tempel, S.A., will only cover the return transport costs to the customer, once the product has been repaired. In the event that the product is outside the warranty period, or it is determined that the product is undamaged or the warranty has been cancelled, the transport costs for both shipping and returning the product will be borne by the customer.
    6. The warranty service will be offered at any of the Tempel, S.A. offices in Spain. In the event that Tempel's technical staff is required to travel to cover any concept included in the Tempel, S.A. guarantee, the travel rates in force for the corresponding year will be applied, both for travel and for the hours spent outside the Tempel, S.A. laboratories.
    7. In warranty repairs Tempel, S.A. reserves the right to decide on the most appropriate actions to be carried out, repair, replacement, configuration, etc. In cases where the material must be replaced, if it is not possible to obtain the same reference from the manufacturer, an equivalent alternative will be proposed.
    8. In order to accept a product under warranty, it is essential that it is in good condition and without signs of tampering and preferably identified with a serial number or batch number.
  4. Exclusionary actions
    1. Tempel, S.A., does not offer urgent assistance services, nor repair services outside official opening hours or on non-working days (weekends, national and regional holidays).
    2. Tempel, S.A., does not offer any replacement service of the same or equivalent material during the time required to repair the product. The customer must have spare equipment for the correct operation of its activity.
    3. Tempel, S.A. does not establish a maximum repair time. This will be determined according to the services to be carried out on the equipment and the time needed to acquire the spare parts for the parts to be repaired or replaced.
    4. Tempel, S.A. is not responsible for the loss of data or other devices that may be affected by possible failures of our products.
    5. Equipment that is out of warranty or that has been cancelled due to non-compliance with any established condition or application of any exclusion, will have a repair or replacement estimate, as well as a charge for the study and analysis of the problem according to the rates in force for the corresponding year.

      The customer shall have a maximum period of 30 days to accept the estimate. Once this period has elapsed, a new repair estimate must be requested. In the event that the customer does not accept the estimate and no subsequent communications are received on how to proceed with the products sent to our repair services, follow-up communications will be sent every 2 months. If after 6 months, counted from the issuance of the repair estimate, there is no response to these communications or not received any other type of notification, Tempel reserves the right to give the treatment it deems most appropriate to the product (destruction, recycling, etc.). Similarly, all those repairs or technical services completed that have not been collected by customers after our notification will be treated according to their nature (destruction, recycling, etc.) within a maximum period of 6 months.

    6. In cases where the customer prefers to take advantage of the manufacturer's warranty, this will be subject to the rules and conditions stipulated by the manufacturer itself, being Tempel, S.A. out of any responsibility. For products supplied and invoiced by Tempel, S.A. if the customer is interested, Tempel, S.A. offers to manage and send the material to the manufacturer acting as an intermediary, being the customer solely responsible for shipping costs, repair or any other existing cost, as well as the decision that the manufacturer may take regarding the repair.
    7. Tempel, S.A. is not responsible for the installation/uninstallation work of products sent as defective, these shall be borne by the customer.
    8. Any product sent under warranty and that is not defective or that the warranty is voided, the customer will assume the possible costs of diagnosis and revision that this may cause, as well as the shipping and return transport costs.
  5. General exclusionsThe Products shall be exempt from the commercial warranty for damage and malfunctions arising from:
    1. The arbitrary modification of the product or the change of its operation without the authorisation of Tempel, S.A.
    2. Product defects arising due to updated technology, or renewal of national or regional laws or regulations.
    3. Damage to products caused by the customer deliberately or by an intentional act.
    4. Product faults not reported to Tempel, S.A., at the time of their appearance.
    5. Tempel, S.A. with this guarantee is not responsible for any damage caused to its products due to causes derived from a bad electrical supply, electrical voltage problems, line overloads, accidents, corrosion, oxidation, exposure to chemical products, vapours, humidity, over temperature or any other external factor not attributable to the manufacture and quality of the product including natural disasters, vandalism, theft, loss, fire, accidents among others and other external causes.
    6. Accidents, falls, negligent, improper or inappropriate use.
    7. The product warranty will be void in the event of tampering or attempted repair by the customer or any other company or person not previously authorised by Tempel, S.A.
    8. Failure to observe the instructions for installation, use, storage and maintenance established by the manufacturer or the technical and safety regulations and standards in force, at national or local level, which are applicable at any given time.
    9. Wrong selection or sizing of battery type and capacity.
    10. Operating temperatures of batteries and cells out of range during charging, discharging or storage.
    11. Inappropriate charging and discharging of batteries, either due to the type of charger used or the charging regime applied for each type of application.
  6. Exclusions for VRL batteriesIn addition to the general exclusions described above, VRLA batteries shall be exempt from the warranty claims set forth herein for damage and malfunctions or service failures of the batteries arising from:
    1. Storage conditions different from those indicated by the manufacturer. The storage temperature should not exceed 25°C and should be kept in a dry environment and protected from any source of heat or direct solar radiation. Every 5-6 months a refreshing charge should be given to the stored batteries.
    2. Tampering with the battery safety valves. This action will result in immediate loss of warranty. The lead acid batteries supplied are of the sealed VRLA type, do not require topping up with distilled water and do not require electrolyte.
    3. Battery operating temperatures outside the range 15 to 25°C. The present warranty is subject to guarantee a maximum temperature of 25±3°C. Temperatures of 28°C or higher require a charge voltage compensation depending on the temperature, causing a decrease in the expected battery life design. The warranty period will be reduced by 50% for every 10°C of temperature above the operational reference temperature of 25°C.
    4. Discharge the batteries to depths of discharge greater than 50%.
  7. Exclusions for LFP 12.8V and 25.6V KAISE KBLI LFP batteriesIn addition to the general exclusionary actions described above, KAISE KBLI 12.8V and 25.6V batteries shall be exempt from the warranty claims set forth herein for damages and malfunctions or service failures of the batteries which have their origin in:
    1. Operating conditions different from those indicated below:
      • Discharge the batteries to depths of discharge greater than 80%.
      • Battery operating temperatures outside the range 15 to 35°C. The highest temperature shall not exceed 45°C, and the warranty shall be void for temperatures of 55°C or higher.
      • The charge voltage setting should be 14.6V per 12.8V battery and 29.2V per 25.6V battery. Both cases with a maximum charge current of 0.2C.
    2. Storage or maintenance conditions other than those indicated below:
      • The storage temperature shall be between 15ᵒC and 30ᵒC.
      • The battery should be stored at 50 % SOC.
      • The product should be kept in a dry environment and protected from any source of heat or direct sunlight.
      • Every 5-6 months a refresh charge should be given to the stored batteries.
  8. Exclusions for LFP 48V NPFC batteriesIn addition to the general actions and exclusions described above, LFP batteries shall be exempt from the warranty claims set forth herein for damage and malfunctions or service failures of the batteries which arise from
    1. The battery must be immediately recharged among the first 18 h after it has been fully discharged and the over-discharge protection has been initiated
    2. The user must download a duly documented monthly BMS memory log of the battery to track its performance and keep the warranty valid, at a minimum, the following data must be included
      • Number of cycles achieved / realised.
      • Depth of discharge per cycle.
      • Duration of each cycle, with their respective loading and unloading regimes.
      • Ambient and battery surface temperature.
    3. Operating conditions different from those indicated below:
      • Daily depth of discharge no greater than 50%.
      • The surface temperature of the battery shall not be higher than 55ᵒC or lower than 5°C.
      • Battery operating temperatures on charge and discharge should be in the range of 15ᵒC to 30ᵒC, the highest daily temperature recorded should not be greater than 40°C for a time greater than 15 calendar days continuously.
      • Cut-off or end-of-discharge voltage lower than 46V
      • For battery banks in parallel, the following discharge current conditions must be met:
        • 48NPFC50, 48NPFC80, 48NPFC100
          • 1 paralelo: < 1C[A]
          • 2 ~ 5 paralelos: < 0.5C[A]
          • 6 ~ 8 paralelos: < 0.3C[A]
        • 48NPFC160
          • 1 paralelo: < 0.5C[A]
          • 2 ~ 5 paralelos: < 0.25C[A]
          • 6 ~ 8 paralelos: < 0.2C[A]
        • 48NPFC200
          • 1 paralelo: < 0.5C[A]
          • 2 ~ 5 paralelos: < 0.25C[A]
          • 6 ~ 8 paralelos: < 0.2C[A]
      • Use of different batteries of different make, model, manufacturer and age in the same battery bank.
      • Parameter settings of rectifiers, regulators and inverters different from those recommended by the battery manufacturer.
    4. Floating charge voltage and compensation voltage settings different from those given below:
      • Floating tension: 54 to 54.5 V per 48 V battery
      • Equalization voltage (if configured): 54V ~ 54.5V
      • Maximum load current: 0.5C[A]
    5. Storage or maintenance conditions other than those indicated below:
      • The storage temperature shall be between 15ᵒC and 30ᵒC.
      • The battery should be stored at 50 % SOC.
      • The product should be kept in a dry environment and protected from any source of heat or direct sunlight.
      • Every 5 ~ 6 months a refresh charge should be given to the stored batteries.
    6. Installation instructions and maintenance actions should be carried out in accordance with the product's operation manual and properly documented (routine maintenance is recommended every 3 months).
    7. In any case, it should be avoided to keep the battery at a voltage of 43.2V or lower for a prolonged period of time, especially under temperature conditions below 15°C.
  9. Limitations on general liabilityTempel, S.A. shall not be liable to the customer, either directly or indirectly, for any failure or delay in the application of its guarantee obligations, which may be caused by force majeure or any other unforeseen incident beyond the control of Tempel, S.A.

    The liability of Tempel, S.A. derived from this Guarantee document shall be limited to the obligations expressed above and, quantitatively, to the amount of the invoice paid by the customer for the purchase of the batteries subject to claim, expressly excluding any liability for indirect damages such as loss of income or operating profits, etc.

    The aforementioned limitations of warranty shall apply insofar as they do not contradict the legal provisions applicable in the respective country with regard to product liability. In the event of the invalidity of any of the above provisions, the invalidity shall only apply to that particular provision and the remaining provisions shall remain in full force and effect.

    Any other warranty claims not expressly mentioned herein are excluded.

  10. Claiming warranty claimsAny customer or user who considers with justified reasons to claim the warranty rights set out in this document, shall proceed as follows:
    1. To enforce the warranty of the products covered under this warranty, it is necessary to previously complete the RMA request and the various technical documents that are estimated by the RMA Department, leaving a written record of the warranty request and send it along with the corresponding purchase invoice to the facilities of Tempel, SA The RMA number will be the reference with which at any time may request information on the status of the work being carried out in the laboratories of Tempel, SA The application form can be requested by telephone or via email: rma@tempelgroup.com.
    2. Once this claim has been received, the Tempel, S.A. RMA Department will analyse it, assessing whether or not it is justified under the provisions of this limited warranty document and informing the customer of the instructions to be followed in each case.
    3. The shipment of the products subject to claim, may not be made without the prior written consent of Tempel, SA Products requiring the execution of this warranty must be sent to Tempel, SA in its original packaging or failing that one of similar characteristics and with proper protection, if the product suffers any damage or breakdown during shipment, would be immediately exempt from this warranty. Additional faults will be corroborated by taking as references the faults, damage or breakdowns described in the service request.
  11. Technical service rates for non-warranty products and other repair services are available on the Tempel, S.A. website.

    If repair estimates are required, they shall be submitted in accordance with the scope of services required and including all associated costs. Prior to the execution of any technical service with a quotation, the customer's approval must be obtained.

  12. If any provision of this Commercial Guarantee is declared void or unenforceable by any court or administrative body of competent jurisdiction, such provision shall be deemed to have been modified to achieve, to the extent possible, the same economic effect as the original deleted provision of this Commercial Guarantee, and the remaining provisions of this Guarantee shall continue in full force and effect.
  13. This warranty document is valid from the purchase of the products and will be applicable to all products supplied by Tempel, S.A., remaining valid until its edition is changed.
  14. Tempel, S.A., reserves the right to extend the warranty periods. Therefore, the validity of the warranty extension shall be subject to technical and commercial approval by Tempel, S.A., according to the conditions specified below and by signing and accepting the Annex A.

COMMERCIAL GUARANTEE FOR PRODUCTS OF THE ENGINEERING LINE

 

  1. GUARANTEE LIMITED:

 

Tempel, S.A., (hereinafter also referred to as "Tempel"), a distributor of electronic and telecommunications equipment and its components, with registered office at Calle Cobalto, 4 (08907) in Hospitalet de Llobregat. It declares that the products marketed are free of any manufacturing or operational defects or damage caused by improper handling.

 

Tempel, S.A., hereby grants the commercial guarantee (hereinafter also referred to as the "Guarantee"), provided that the products are used under the normal conditions of use determined by the manufacturers; and under the general terms and conditions expressed below:

 

  1. DURATION OF THE GUARANTEE:

 

  • All products of the Engineering line marketed by Tempel, S.A., have a limited warranty of 24 months starting from the date indicated on the purchase invoice or delivery note of the material, with the exception of the following cases which will have a limited warranty of 12 months:
  • Products including LCD / CRT
  • Products discontinued by the manufacturer
  • Obsolete Products
  • Opportunities and special offers

Laptops and rugged tablets are exempt from these warranty periods and the manufacturer's warranty period shall apply.

  • Repairs carried out in Tempel, S.A. have a limited warranty of 90 days, which extends beyond the termination of the general warranty periods previously stipulated. This warranty will only cover the parts subject to repair or replacement, in no case the entire equipment.

  • In warranty repairs Tempel, S.A., reserves the right to decide on the most appropriate actions to be carried out, repair, replacement, configuration, etc. In cases where the material must be replaced, if it is not possible to obtain the same reference from the manufacturer, an equivalent alternative will be proposed.
  • In order to accept a product under warranty, it is essential that it is in good condition and without signs of tampering and identified with a serial number or batch number.

 

  1. EXCLUSIONARY ACTIONS:

 

  • Tempel, S.A., is not responsible for the data stored in the equipment sent for repair. The customer must have their backup copies before sending them to our warehouses.
  • Tempel, S.A., does not offer urgent assistance services, nor repair services outside official opening hours or on non-working days (weekends, national and regional holidays).
  • Tempel, S.A., does not offer any replacement service of the same or equivalent material during the time required to repair the product. The customer must have spare equipment for the correct operation of its activity.
  • Tempel, S.A. does not establish a maximum repair time. This will be determined according to the services to be carried out on the equipment and the time needed to acquire the spare parts for the parts to be repaired or replaced.
  • Tempel, S.A. is not responsible for the loss of data or other devices that may be affected by possible failures of our products.

  • Tempel, S.A. is not responsible for the installation/uninstallation work of products sent as defective, these shall be borne by the customer.
  • Any product sent under warranty and that is not defective or that the warranty is voided, the customer will assume the possible costs of diagnosis and revision that this may cause, as well as the shipping and return transport costs.

The Products shall be exempt from the commercial warranty for damage and malfunctions arising from:

  • Tempel, S.A. with the present commercial guarantee is not responsible for any damage caused to its products due to causes derived from a bad electrical supply, electrical voltage problems, line overloads, accidents, corrosion, oxidation, exposure to chemical products, vapours, humidity, over temperature or any other external factor not attributable to the manufacture and quality of the product including natural disasters, theft, loss, fire, accidents among others and other external causes.
  • Accidents, falls, negligent, improper or inappropriate use.
  • The product warranty will be void in the event of tampering or attempted repair by the customer or any other company or person not previously authorised by Tempel, S.A.
  • Failure to observe the instructions for installation, use, storage and maintenance established by the manufacturer or the technical and safety regulations and standards in force, at national or local level, which are applicable at any given time.
  • Wrong selection or sizing of equipment type and capacity.

 

  1. LIMITATIONS OF GENERAL LIABILITY:

 

  • Tempel, S.A. shall not be liable to the customer, either directly or indirectly, for any failure or delay in the application of its guarantee obligations, which may be caused by force majeure or any other unforeseen incident beyond the control of Tempel, S.A.
  • The liability of Tempel, S.A. derived from this commercial guarantee document shall be limited to the obligations expressed above and, quantitatively, to the amount of the invoice paid by the customer for the purchase of the products subject to the claim, expressly excluding any liability for indirect damages such as loss of income or operating profits, etc.
  • The aforementioned limitations and other conditions set forth in this warranty document shall apply insofar as they do not contravene the legal provisions applicable in each country with regard to product liability. In the event that any of the above provisions are invalidated, the invalidity shall only apply to that particular provision and the remaining provisions shall remain in full force and effect.
  • Any other warranty claims not expressly mentioned herein are excluded.

 

  1. CLAIMING WARRANTY CLAIMS:

  1. CURRENT RATES FOR TECHNICAL SERVICES:

 

Technical service rates for non-warranty products and other repair services are available on the Tempel, S.A. website.

 

If repair estimates are required, they shall be provided in accordance with the scope of services required and including all costs associated with the service. Prior to the execution of any technical service with a quotation, the approval of the customer must be obtained.

 

  1. APPLICABLE LAW

 

If any provision of this commercial guarantee is declared invalid or unenforceable by any court or administrative body of competent jurisdiction, such provision shall be deemed to have been modified to achieve, to the extent possible, the same economic effect as the original deleted provision of this commercial guarantee, and the remaining provisions of this commercial guarantee shall continue in full force and effect.

 

  1. ENTRY INTO FORCE, APPLICATION AND VALIDITY OF THE DOCUMENT:

 

This warranty document is valid from the purchase of the products and will be applicable to all products supplied by Tempel, S.A., remaining valid until its edition is changed.

 

  1. WARRANTY EXTENSION:

 

Tempel, S.A., reserves the right to extend the warranty periods. Therefore, the validity of the warranty extension shall be subject to technical and commercial approval by Tempel, S.A., according to the conditions specified below and by signing and accepting the Annex A.

 

  • The commercial warranty extension periods will be conditioned by the useful life of the product and cannot be extended in all cases.
  • Applications will be evaluated by the Tempel, S.A. repair team and cannot be extended in all cases.
  • Extensions of warranty shall be subject to the conditions, exclusions and limitations set forth herein without the need for any additional agreement.
  • For the validity of the extension of warranty, the Annex A by an authorised officer of each company. Electronic signatures based on certificates issued by competent authorities shall also be valid.
  • It is essential to register in the Annex AThe serial numbers of all products that require to be included in the extended warranty agreement. In no case shall an item whose serial number is not recorded on the extension of warranty signature be accepted as an extension of warranty.
  • Any services to be covered by the extended guarantee agreement must be budgeted for, accepted and reflected within the Annex A. In no case will services not specified in this document be covered. Additional services not included in the extension agreement will be subject to a feasibility study and will be subject to an additional budget, which must be previously approved by the client.
